Regulations on the Administration of Pesticides (Second Revision pursuant to the Decision of the State Council on Amending and Repealing Certain Administrative Regulations dated March 29, 2022) Note: State Council Order No. 752 promulgated the Decision of the State Council on Amending and Repealing Certain Administrative Regulations, which came into force on May 1, 2022. Attachment: 1. Administrative Regulations Amended by the State Council—VI. Delete Paragraph 3 of Article 9 of the Regulations on the Administration of Pesticides (i.e., “Applications for registration trials of new pesticides shall be submitted to the competent agricultural authority under the State Council. Within forty working days from the date of acceptance of the application, the competent agricultural authority under the State Council shall review the safety risks of the trial and the corresponding preventive measures; if the conditions are met, the trial shall be approved; if not, the applicant shall be notified in writing with reasons.”). Regulations on the Administration of Pesticides (Promulgated by Order No. 216 of the State Council of the People’s Republic of China on May 8, 1997; First revised pursuant to the Decision of the State Council on Amending the Regulations on the Administration of Pesticides dated November 29, 2001; Revised and adopted at the 164th Executive Meeting of the State Council on February 8, 2017; Second revised pursuant to the Decision of the State Council on Amending and Repealing Certain Administrative Regulations dated March 29, 2022) Chapter I General Provisions Article 1 These Regulations are formulated to strengthen pesticide management, ensure pesticide quality, safeguard the safety of agricultural products and human and animal health, protect agricultural and forestry production as well as the ecological environment. Article 2 For the purposes of these Regulations, “pesticide” refers to a substance or a mixture of substances, including their formulations, that is chemically synthesized or derived from biological or other natural sources, used to prevent or control diseases, pests, weeds, rodents, and other harmful organisms affecting agriculture and forestry, or to purposefully regulate plant and insect growth. The pesticides specified in the preceding paragraph include the following categories, intended for different purposes and applications: (1) Prevention and control of diseases, pests (including insects, ticks, mites), weeds, rodents, mollusks, and other harmful organisms affecting agriculture and forestry; (2) Prevention and control of diseases, pests, rodents, and other harmful organisms in storage and processing facilities; (3) Regulation of plant and insect growth; (4) Preservation or freshness of agricultural and forestry products; (5) Prevention and control of mosquitoes, flies, cockroaches, rodents, and other harmful organisms; (6) Prevention and control of harmful organisms threatening river embankments, railways, docks, airports, buildings, and other sites. Article 3 The competent agricultural authority under the State Council is responsible for nationwide pesticide supervision and administration. Agricultural authorities of local people’s governments at or above the county level are responsible for pesticide supervision and administration within their respective administrative areas. Other relevant departments of people’s governments at or above the county level shall, within their respective jurisdictions, undertake related pesticide supervision and administration duties. Article 4 Local people’s governments at or above the county level shall strengthen organizational leadership over pesticide supervision and administration, include funding for such activities in their respective government budgets, and ensure the effective implementation of these functions. Article 5 Pesticide manufacturers and operators shall bear responsibility for the safety and efficacy of the pesticides they produce and market, and voluntarily accept government oversight and public scrutiny. Pesticide manufacturers and operators shall enhance industry self-discipline and standardize their production and business practices. Article 6 The state encourages and supports the research, production, and use of safe, efficient, and economical pesticides, promotes professionalized pesticide application, and facilitates the upgrading of the pesticide industry. Units and individuals who have made outstanding contributions in pesticide research, promotion, and supervision shall be commended or rewarded in accordance with relevant state regulations. Chapter II Pesticide Registration Article 7 The state implements a pesticide registration system. Pesticide manufacturers and enterprises exporting pesticides to China must apply for pesticide registration in accordance with these Regulations; developers of new pesticides may also apply for registration under these Regulations. The agency under the competent agricultural authority of the State Council responsible for pesticide inspection undertakes specific tasks related to pesticide registration. Agencies under the agricultural authorities of provincial, autonomous regional, and municipal people’s governments assist in carrying out specific registration tasks within their respective administrative areas. Article 8 The competent agricultural authority of the State Council establishes a Pesticide Registration Review Committee responsible for reviewing pesticide registration applications. The Pesticide Registration Review Committee comprises the following members: (1) Experts recommended by relevant departments of the State Council—including those responsible for agriculture, forestry, health, environmental protection, grain, industrial regulation, and work safety—as well as representatives from organizations such as the All-China Federation of Supply and Marketing Cooperatives, specializing in pesticide chemistry, efficacy, toxicology, residue analysis, environmental impact, quality standards, and testing; (2) Relevant experts from the National Food Safety Risk Assessment Expert Committee; (3) Representatives from relevant departments of the State Council and organizations such as the All-China Federation of Supply and Marketing Cooperatives. The rules governing pesticide registration reviews are formulated by the competent agricultural authority of the State Council. Article 9 Applicants for pesticide registration must conduct registration trials. Registration trials must be filed with the agricultural authority of the province, autonomous region, or municipality where the trial is conducted. Article 10 Registration trials shall be carried out by designated registration trial institutions recognized by the competent agricultural authority of the State Council, in accordance with its prescribed procedures. Pesticides having identical ingredients, scope of use, and methods of application as those already registered in China are exempt from residue and environmental testing; however, if such pesticides are still within the period of data protection stipulated in Article 15 of these Regulations, authorization from the holder of the pesticide registration certificate is required. Registration trial institutions shall be responsible for the authenticity of the registration trial reports. Article 11 Upon completion of the registration trial, applicants must submit a pesticide registration application to the agricultural authority of the province, autonomous region, or municipality where the trial was conducted, along with supporting documents such as the registration trial report, sample labels, and pesticide product quality standards and testing methods. For applications for new pesticide registration, additional reference samples of the pesticide must also be provided. The agricultural authorities of provinces, autonomous regions, and municipalities shall, within twenty working days of receiving the application, issue preliminary review opinions and forward them to the competent agricultural authority of the State Council. Enterprises exporting pesticides to China must submit the materials specified in the first paragraph of this article, together with pesticide reference samples and evidence of registration and use in relevant countries or regions, when applying for pesticide registration with the competent agricultural authority of the State Council. Article 12 Upon receipt of an application or the submission of application materials by the agricultural authorities of provinces, autonomous regions, or municipalities, the competent agricultural authority of the State Council shall organize review and registration evaluation, and render an approval decision within twenty working days of receiving the evaluation opinion. If the conditions are met, a pesticide registration certificate shall be issued; otherwise, the applicant shall be notified in writing with reasons. Article 13 A pesticide registration certificate shall specify the pesticide name, formulation, active ingredients and their content, toxicity, scope of use, methods and dosage of application, certificate holder, certificate number, and validity period, among other details. The validity period of a pesticide registration certificate is five years. Upon expiration, if the holder intends to continue producing the pesticide or exporting it to China, they must apply to the competent agricultural authority of the State Council for renewal ninety days prior to the expiry date. If any information listed on the pesticide registration certificate changes, the certificate holder must apply for amendment in accordance with the regulations of the competent agricultural authority of the State Council. The competent agricultural authority of the State Council shall promptly announce the issuance, renewal, and amendment of pesticide registration certificates, as well as related information such as pesticide product quality standard numbers, residue limit regulations, testing methods, and approved label designs. Article 14 Developers of new pesticides may transfer the registration data of their newly registered pesticides; pesticide manufacturers may transfer the registration data of their registered pesticides to other manufacturers possessing equivalent production capabilities. Article 15 The state provides protection for test data and other information independently obtained and undisclosed by applicants seeking initial registration of pesticides containing novel compounds. For six years from the date of registration, no registration shall be granted if another applicant uses the aforementioned data without the consent of the original registrant; however, exceptions apply to cases where the second applicant submits data independently obtained. Except under the following circumstances, the registration authority shall not disclose the data specified in the first paragraph of this article: (1) When necessary for the public interest; (2) When measures have been taken to ensure that such information will not be improperly exploited for commercial purposes. Chapter III Pesticide Production Article 16 Pesticide production shall comply with national industrial policies. The state encourages and supports pesticide manufacturers in adopting advanced technologies and management practices to enhance pesticide safety and efficacy. Article 17 The state implements a pesticide production licensing system. Pesticide manufacturers must meet the following requirements and apply to the agricultural authorities of provincial, autonomous regional, or municipal people’s governments for a pesticide production license in accordance with the regulations of the competent agricultural authority of the State Council: (1) Possess technical personnel suitable for the type of pesticide being produced; (2) Have factory premises and facilities appropriate for the intended production; (3) Employ personnel, instruments, and equipment capable of conducting quality management and quality inspections for the intended pesticide; (4) Establish internal rules and regulations ensuring the quality of the pesticide being produced. The agricultural authorities of provincial, autonomous regional, and municipal people’s governments shall, within twenty working days of receiving the application, make an approval decision, and conduct on-site verification if necessary. If the conditions are met, a pesticide production license shall be issued; otherwise, the applicant shall be notified in writing with reasons. In addition to the provisions set forth herein, pesticide manufacturers must also comply with other legal and administrative regulations concerning enterprise production conditions, such as those related to workplace safety and environmental protection. Article 18 A pesticide production license shall specify the manufacturer’s name, address, legal representative (or person in charge), scope of production, production address, and validity period, among other details. The validity period of a pesticide production license is five years. Upon expiration, if the manufacturer intends to continue production, they must apply to the agricultural authorities of the province, autonomous region, or municipality for renewal ninety days before the expiration date. If any information listed on the pesticide production license changes, the manufacturer must apply for amendment in accordance with the regulations of the competent agricultural authority of the State Council. Article 19 For commissioned processing or repackaging of pesticides, the commissioning party must obtain the corresponding pesticide registration certificate, while the contractor must hold a pesticide production license. The commissioning party shall assume responsibility for the quality of the processed or repackaged pesticides. Article 20 When purchasing raw materials, pesticide manufacturers must verify the certificates of product quality inspection and relevant permits, and shall not procure or use raw materials lacking legally required certificates of product quality inspection or permits.Pesticide manufacturers shall establish a system for recording raw material purchases, accurately documenting the name of each raw material, the relevant license document number, specifications, quantity, the supplier’s name and contact information, as well as the date of purchase. Such records must be retained for at least two years. Article 21: Pesticide manufacturers shall strictly adhere to product quality standards during production, ensuring that the finished pesticide products conform to those registered. Before being released for sale, pesticides must pass quality inspection and be accompanied by a certificate of compliance. Pesticide manufacturers shall also establish a system for recording pesticide sales, accurately documenting the pesticide’s name, specifications, quantity, production date and batch number, quality inspection details, the purchaser’s name and contact information, and the date of sale. These sales records must be retained for at least two years. Article 22: Pesticide packaging shall comply with relevant national regulations and bear printed or affixed labels. The state encourages pesticide manufacturers to use recyclable packaging materials. Pesticide labels shall, in accordance with the regulations of the State Council’s agricultural administrative department, clearly indicate in Chinese the pesticide’s name, formulation, active ingredients and their content, toxicity and associated symbols, scope of use, methods and dosage of application, technical requirements and precautions, production date, and traceability electronic information codes, among other necessary details. Labels for highly toxic, acutely toxic pesticides, as well as other restricted-use pesticides with stringent application requirements, must additionally display the words “Restricted Use” and specify any special restrictions or particular conditions for use. Labels for pesticides intended for use on food crops must also indicate the pre-harvest interval. Article 23: Pesticide manufacturers may not unilaterally alter approved label contents, nor may they include false or misleading information on pesticide labels that could mislead users. If the packaging is too small to accommodate all required label information, an accompanying instruction manual must be provided, with content consistent with the approved label. Chapter IV: Pesticide Distribution Article 24: The state implements a licensing system for pesticide distribution, except for sanitary-use pesticides. Pesticide distributors must meet the following conditions and apply to the local agricultural administrative department at or above the county level for a pesticide distribution license, in accordance with the regulations of the State Council’s agricultural administrative department: (1) Employ personnel who possess professional knowledge of pesticides and pest control, are familiar with pesticide management regulations, and can provide guidance on the safe and rational use of pesticides; (2) Maintain business premises and storage facilities effectively segregated from other goods, drinking water sources, residential areas, and other sensitive locations, equipped with protective facilities appropriate to the types of pesticides being distributed; (3) Establish systems for quality management, record-keeping, safety protection, emergency response, and warehouse management, tailored to the specific pesticides being handled. For distributors handling restricted-use pesticides, additional specialized technical personnel trained in pesticide application and pest control must be assigned, and operations must follow designated-location requirements set by the provincial, autonomous region, or municipality-level agricultural administrative departments. Local agricultural administrative departments at or above the county level shall render a decision within twenty working days of receiving the application. If the applicant meets the requirements, a pesticide distribution license will be issued; if not, the applicant will receive written notification stating the reasons for rejection. Article 25: A pesticide distribution license shall specify the distributor’s name, address, responsible person, scope of business, and validity period. The license is valid for five years. Upon expiration, distributors wishing to continue operating must submit an application for renewal to the issuing authority no later than ninety days before the license expires. Should any changes occur in the particulars listed on the license, the distributor must, in accordance with the regulations of the State Council’s agricultural administrative department, apply for an amendment to the license. A distributor holding a valid pesticide distribution license who establishes branch offices must, in accordance with the law, apply for an amendment to the license and file a record with the local agricultural administrative department at or above the county level where the branch is located; such branches are exempt from obtaining separate licenses. The distributor remains fully responsible for the operational activities of its branches. Article 26: When purchasing pesticides, distributors must verify product packaging, labels, certificates of quality inspection, and relevant licensing documents, and shall not procure pesticides from manufacturers lacking a pesticide production license or from other distributors without a valid pesticide distribution license. Distributors must maintain a procurement ledger, accurately recording the pesticide’s name, relevant license document numbers, specifications, quantities, manufacturer and supplier names and contact information, as well as the date of purchase. This ledger must be retained for at least two years. Article 27: Distributors must also maintain a sales ledger, accurately documenting the pesticide’s name, specifications, quantity, manufacturer, purchaser, and date of sale. Such records must be kept for at least two years. Distributors should inquire about the occurrence of pests and diseases from purchasers and make scientifically informed recommendations regarding pesticide use; when necessary, they should conduct on-site inspections.
Dear Member Organizations: This June marks the 21st National “Work Safety Month.” To thoroughly study and implement General Secretary Xi Jinping’s important instructions on work safety, firmly establish the concept of safe development, strengthen publicity efforts for work safety, encourage enterprises to fulfill their primary responsibility for work safety, effectively prevent and manage safety risks, enhance the inherent safety level of enterprises, and promote a sustained and steady improvement in work safety within the pesticide industry, the Association calls upon all member organizations to earnestly carry out activities for the 2022 “Work Safety Month.” Relevant matters are hereby notified as follows: I. Theme of the Campaign “Comply with the Work Safety Law and Be the Primary Person Responsible” II. Activities (1) Conduct Thematic Education to Strengthen Work Safety Awareness Taking the opportunity of organizing the National “Work Safety Month” activities, arrange at least one session of theoretical study, organize collective viewing of the TV documentary “Life Is Heavier Than Mount Tai—Studying General Secretary Xi Jinping’s Important Expositions on Work Safety,” and deepen understanding of his key ideas on work safety. Through thematic seminars, centralized briefings, training sessions, and other formats, translate learning outcomes into tangible results that advance safe development. Diligently organize study and dissemination of the fifteen measures for work safety; enterprise leaders should take the lead in emphasizing safety, with the primary responsible person delivering dedicated safety lectures, frontline workers participating in interactive discussions, and conducting open classes, group talks, and team meetings on work safety. (2) Study and Implement the Work Safety Law to Encourage the “Primary Person Responsible” to Comply with Laws and Fulfill Duties The legal representative, actual controller, and person in charge of each enterprise must consciously prioritize safety throughout all aspects of their work, truly assume the responsibilities of the “primary person responsible” for work safety, strictly fulfill the seven duties stipulated by the Work Safety Law, and take the lead in respecting, studying, and abiding by the law. They should proactively assess risks, identify potential hazards, organize comprehensive emergency response drills and knowledge‑training sessions for all employees, and actively participate in the “Safety Pledge by the Primary Person Responsible” campaign. (3) Provide Safety Skills and Knowledge Training to Enhance Enterprises’ Inherent Safety Level Promote the philosophy of safe development, disseminate safety knowledge, and cultivate a safety culture. Conduct training on workplace safety and fire‑prevention skills to further reinforce the principle that enterprise leaders “must prioritize safety,” safety management personnel “should know how to ensure safety,” and all employees “understand safety.” Widely launch initiatives such as “I Am a Safety Whistleblower” and “Identify Hazards Around Us” to motivate employees to actively and voluntarily fulfill their work safety responsibilities. Focus on key workshops, critical processes, and pivotal positions, encouraging staff to conduct self‑inspections and corrective actions on essential equipment and major operations, collaboratively identifying risks and hazards, thereby improving the overall inherent safety level of the enterprise. (4) Conduct Emergency Response Drills to Enhance Emergency Rescue Capabilities Further revise and refine emergency response plans, continuously improve the dual prevention mechanism of risk control and hazard elimination, especially for enterprises involved in the production of hazardous chemicals. Thoroughly identify and address significant safety risks, conduct extensive on-site response drills and emergency procedures tailored to key positions—particularly practical, hands‑on initial response exercises for workshop and team members—strengthen awareness of standards and regulations, and enhance emergency response capabilities. During “Work Safety Month,” organize at least one emergency drill to continually boost emergency rescue preparedness. (5) Actively Participate in “Safety Promotion and Consultation Day” Events to Strengthen Social Responsibility Utilize banners, posters, display windows, short videos, official WeChat accounts, and other media channels to carry out multi‑faceted, three‑dimensional publicity campaigns, vigorously promoting the Work Safety Law and related regulations, widely disseminating safety knowledge, and fostering a strong atmosphere of “caring for life and prioritizing safety.” In conjunction with enterprise characteristics, organize engaging safety promotion and consultation events for employees’ families and local community residents, launching initiatives such as “Bringing Safety Home,” “Delivering Safety Door‑to‑Door,” “Safety Volunteers in Action,” and various emergency response experience activities. Together, raise public awareness of safety and emergency preparedness, reinforcing corporate social responsibility. III. Support for the Campaign During the campaign period, the China Pesticide Industry Association will leverage its own media platforms to widely publicize exemplary activity cases, highlight advanced models, and harness the demonstration effect of outstanding enterprises to elevate the overall level of work safety publicity within the pesticide industry. All member organizations are requested to submit outstanding activity videos, promotional reports, or summaries of experiences to the China Pesticide Industry Association by June 30.
